Wednesday 15 March 2017 bail was then set at R1000 at the Durban magistrates court. State prosecutor ,Veneshree Moodley said, after close scrutiny of the case kidnapping charges were inappropriate and therefore dropped.

Instead, fraud and defeating the ends of justice were instated. She further elaborated that, fraud relates to misrepresenting to the South African Police therefore causing them to act at great cost to the state.

The charge of defeating the ends of justice relates to the charge of hijacking which was previously opened, action which attracted high cost and public outrage when it was discovered that the child was not kidnapped.

The state did not oppose bail. The unmarried 26 year-old father of 3 children, meter taxi driver and tuck shop owner said he is able to pay bail of R1000,after his lawyer Andile Dakela read out an affidavit of the client’s attestation entailing details relevant to his bail application.

Attorney ,Mfanafuthi Biyela, told the court that his client 34-year-old teacher, is a sole bread winner, mother of 4 children with no previous convictions and her husband is willing to pay bail.

Both mother to the infant child and boyfriend were granted bail of R1000, ordered to surrender any travel documents in their custody and make no application of the same.
